Don't Ask Don't Tell Unconstitutional?

A Federal court ruled that Don't Ask Don't Tell is unconstitutional in that it violates the 1st and 5th amendments. Since when is the military under the bill of rights? You lose your freedom of speech when you join the military. Don't ask don't tell is a ridiculous policy, I am not arguing with that, but this ruling is wrong.
