Arrested For Snooping In Wife's Email?

A man is being charged with a cyber-crime for reading his wife's emails as he was searching to see if she was having an affair. While technically if you read the letter of the law, he did commit a crime, most lawyers are saying there is no way this will be interpreted as such in court. But it does raise a larger question about snooping in a marriage.
