Was Spying On Tyler Clementi A Hate Crime?

The students charged with spying on Tyler Clementi are now being charged with a hate crime. A hate crime!?! I have said before, and will say it again, hate crimes are pointless charges. Things are either a crime or they aren't. But more so than most hate crime charges, this one is even more absurd. This wasn't a hate crime. This was two stupid college students doing what stupid college students do and a gay student who obviously had some psychological issue took it too far. These students should be charged with invasion of privacy - and let's leave it at that.
