Gay Judge Decides Gay Marriage Case

It was released recently that the retiring judge in the 9th Circuit Court of Appeals that decided on the Prop 8 was in fact gay himself. And while I am fine with gay judges deciding gay cases, the fact he didn't at least disclosure that information speaks of deception - and that I do have a problem with.
